Website template terms and conditions

Our website templates do not allow for customisation to the template design and functionality. All colours, logos, copy and images can be changed, but no changes will be made to design and functionality. If there are additional design requests, an extra cost will be incurred or we will suggest a custom website design and development service. The Branding Box website templates are non-exclusive.

Payment schedule

Full payment is required upfront when purchasing a website template. Once payment is received, we will book a time slot for installation and development. If you have selected to purchase the template only, excluding installation and development, your template will be sent through as soon as payment is reflected in our bank account.

Booking your time slot

Once we receive your payment, we will supply a schedule for your website to be designed, installed and developed, depending on the package option selected. Once your schedule has been confirmed, all information, images and copy is required two (2) days prior to your start date.

Product and image limits

For products and gallery images, we have a limit of twelve (12) images. Thereafter you can update and add more images to your website.

Client responsibilities

As the customer, you are empowered and authorised to enter into this agreement on behalf of your company or organisation. You agree to provide The Pencil Box with the information required to develop your website template. We will maintain the confidentiality of any information that you give us. You agree to review our work and sign off approval in a timely manner. Our website templates do not allow for customisation. Deadlines work both ways, so (like us) you are bound by any dates that we have set together. We have the ability to perform the services you require from us, and we will carry them out in a professional and timely manner. We will endeavour to meet all the deadlines set, but we cannot be held responsible for a missed deadline if you have been late in supplying materials, or if you have not approved or signed off our work on time.
We are not responsible for the consequences that may result from the installation of the website template. Before installing the template, it’s important that you save a backup of your website if you already have one. We are not responsible for any issue arising from any modification of any part of the template or code made by the client or their representatives. We will not be responsible for the possible loss of information or the malfunction or breach of security of the site.

Intellectual property

“Intellectual property rights” refers to all patents, rights to inventions, copyright (including rights in software) and related rights, trademarks, service marks, get-up and trade names, Internet domain names, rights to goodwill or to sue for passing off, rights in designs, database rights, rights in confidential information (including know-how) and any other intellectual property rights, in each case whether registered or unregistered and including all applications (or rights to apply) for, and renewals or extensions of, such rights and all similar or equivalent rights or forms of protection which subsist or shall subsist now or in the future in any part of the world. (Phew! That was a mouthful.) You will guarantee that all elements of text/copy, images or other artwork you provide are either owned by you, or that you have permission to use these.

Copyright Policy

By purchasing a WordPress website template from The Pencil Box, you agree to the following terms:
Each template purchase may be used for one (1) website only. If you are found in violation of this policy, you will be required to purchase additional licenses and/or immediately shut down all websites with unauthorised installations of the template. If you are using this WordPress template to build a design for a client, you are prohibited from claiming or promoting these web designs as your own. You may not redistribute, transfer or resell them in any way, shape or form.
You may not share the WordPress template, graphics, files or any design elements provided in your purchase with anyone else.
Any photography provided with the WordPress template is for demonstration purposes only and copyrighted to its original creator. We hold no liability for any image licensing/copyright issues that may occur through your unlawful use of images. The design is copyrighted to The Pencil Box and The Pencil Box owns the rights to all designs and files (excluding any photography) included in your purchase and design. The Pencil Box retains the right to use the completed project and any preliminary designs for the purpose of marketing its business, and may display work created on digital, social media platforms and print. We will not display any confidential artwork.

Return Policy

Due to the fact that all of our products are digital, they cannot be returned or exchanged. We cannot issue refunds after the purchase is made. Please be sure to review the template and features prior to purchasing.

Revisions

The package rate is based on the number of hours that we estimate will be required to accomplish everything we have offered. If you change your mind or add extra requests, that won’t be a problem. It will, however, be charged at our hourly rate. We always endeavour to meet all urgent requests, but we are not always in a position to do so. We allow for two (2) rounds of revisions. One (1) “revision” refers to the client providing one set of feedback, and The Pencil Box actioning that feedback. Should you exceed two (2) rounds of changes, you will be charged at our hourly rate.

Client approval

As our client, you are required to approve and proofread the final website. The Pencil Box will make every effort to ensure that no information is misrepresented. However, the client assumes all responsibility for content. Your approval of the website will be assumed after the work has been submitted for review, unless you indicate otherwise in writing. In order to avoid errors, instructions regarding text/copy or design changes and corrections, will not be taken over the phone, but must be provided electronically.

Completion of project

The work outlined in this agreement will be turned around within a reasonable, non-rush timeframe, which will be determined, where possible, and mutually agreed upon at the start of each project. Late or weekend hours incurred to accommodate additional compressed deadlines, if needed, will be negotiated separately. Our schedules assume timely review by you, the client, of all deliverables. Any delay in completion of the project due to client action or negligence, supplier delays, unforeseen illness, or external forces beyond the control of The Pencil Box, shall entitle The Pencil Box to extend the completion date, upon notifying the client, by the time equivalent to the period of such delay. All work will be completed within the standard work week (Monday through Friday, 9am to 5pm). The Pencil Box is closed on all major holidays, and for a period of three (3) weeks over Christmas and New Year.

Legal stuff

We work within industry best practices, and to the standard expected from a suitably qualified person with relevant experience. However, we cannot guarantee that our work will be completely error-free, and we cannot be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages. Your liability to us will also be limited to the fees payable, and you will not be liable to us or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages.

Acceptance of agreement

The package prices, specifications and conditions are hereby accepted once payment has been made. The Pencil Box is authorised to execute the project as outlined. The purchase of a website template means that you know and accept these conditions.
